The Member of Parliament (MP) for Assin Central is preparing to cite contempt against investigative journalist Anas Aremayaw Anas, said Mr Kennedy Agyapong’s lawyer Ralph Agyapong.
This comes after Accra High School quashed a 25 million GHc defamation case filed by investigative journalist Anas Arimayo against the Hon Kennedy Agyapong.
The trial judge, Judge Eric Bah, dismissed the case and awarded the plaintiff a cost of CK50,000.
Anas Arimayo offered ¥25 million over some comments allegedly made by the MP against him publicly after his investigative article No. 12, which exposed some alleged rot in Ghana football, was aired.
In delivering his ruling, Justice Eric Bah, an appeals court judge who has additional responsibility as a Supreme Court judge, said Anas Aremayao’s case had no merit.
The judge also questioned the press style of the plaintiff Anas Aremiao Anas.
Responding to the verdict, Tiger Eye PI headed by Anas Aremayao Anas said in a statement: “The case passed through three judges and Judge Bah was the last assigned to the case in an express trial from Kennedy Agyapong. Throughout the trial, Mr. Agyabong showed utter disdain and disrespect for the court and his counsel Anas, but all attempts to charge him with contempt have reached a dead end.
But speaking on Kumasi-based Hello FM and the observer from BanglaWebTools.com, the defendant’s attorney Ralph Agyapong noted that Anas’s statement implied that Kennedy had chosen the judge who sat the case to court and hence he is preparing to cite him in contempt of court.
“This statement is extremely contempt. Before you called, I was drafting a contempt motion with it. Anas must come to court,” lawyer Ralph Agyapong told Hello FM.
He also hinted that in their next case, Anas Aremayao would have to appear in person in court.
“This time he must come himself because he is a disordered criminal… You can’t send anyone. He must come and tell the court if it is Kennedy Agyapong who chooses a judge for the court. He will come and prove to the court if Kennedy Agyapong as an individual has the authority to say I choose the judge.” Attorney Agyapong confirmed.
According to him, since Anas is the director of Tiger Eye PI, he has no other choice but to appear in court in person because the Supreme Court has held that you cannot come to court wearing that face mask.
Attorney Ralph Agyapong insisted, “No judge in this republic can oppose an order of the Supreme Court, nor a judge below, so he has to appear before the court.”
